The money back guarantee expressed in our written advertising package and in the on-line advertising price list found in the “advertise here” link on our website is for the client commissioning Dive Planet to advertise on their behalf. The client must show with reasonable accuracy that Dive Planet Company Limited has failed to direct internet traffic and additional business to their site, through the agreed advertising contract entered into by both parties and must notify this failure to the Directors of Dive Planet. An investigation and analysis of all the traffic related statistics available to Dive Planet and provided by the above mentioned client will be undertaken, and if the statistics correspond by showing a failure as outlined above, then a full money back guarantee will be made to the client. |

By becoming a member of the Dive Planet data base, thereby providing your e-mail address, you are eligible to win a prize offered by Dive Planet and ipso facto give Dive Planet permission to send newsletters and offers to that email address. This represents a term of entry into prize draws, and to remain eligible to win any prize offered you must remain and be currently subscribed to such newsletters. Any Prize/s offered on this site by Dive Planet and its suppliers are done so in good faith and Dive Planet does not remain obliged to offer said prizes, should the terms of the prize not be met in full. The recipient or winner of any Dive Planet prize draws has 72 hours to claim the prize offered, failure to do so will nullify their claim to the prize, thereupon the prize will be re-entered into the Dive Planet prize draws. |

Force Majeure |

Dive Planet and its information providers will not be held liable for failure to perform its obligations, including any delay or interruption of goods, services and content if such failure is a result of acts of god, including but not limited to, Fire, Flood, Storm, Hurricane, or other Natural Disaster, War, Invasion, Terrorist Activities, Government Sanctions, Interruption or Failure of Electricity, Telephone or other Interconnect Problems, Server Failures, Computer Viruses, Software Glitches, Unauthorized Access, Failure of Satellite performance and function, Operator errors, Theft and Affiliates and providers of goods and services acting on Dive Planets behalf, that fail to deliver the above mentioned goods and services. |

Law and Jurisdiction |

The terms and conditions above shall be governed by, and in accordance with New Zealand law. Any disputes that may arise between the various parties irrevocably agree to submit to the exclusive jurisdiction of the New Zealand Courts.
